Scope of Services
The Consultant shall perform Conversion Rate Optimization (CRO) services as outlined in the project proposal. These services include performing quantitative analysis of the Client's digital analytics platforms (e.g., Google Analytics), qualitative research (e.g., heatmaps, user session recordings), conducting heuristic reviews, establishing a prioritized testing hypothesis backlog, designing wireframes/copy variants, and setting up, executing, and reporting on A/B tests using the designated optimization software.
Any services not explicitly detailed in the original proposal—including but not limited to core backend website development, brand-new page design outside the test parameters, or managing paid acquisition campaigns—shall be considered out of scope and will require a separate, mutually agreed-upon Change Order.
Client Responsibilities and Dependencies
The success of the CRO campaign is highly dependent on timely Client cooperation. The Client agrees to provide the Consultant with administrative, secure access to all necessary third-party platforms (analytics tools, tag managers, content management systems, A/B testing platforms, and heatmapping tools) within five (5) business days of contract execution.
Furthermore, the Client must designate a primary point of contact for timely feedback and ensure their internal engineering or development team is available to deploy testing tags or review technical implementations when required. Delays in providing access or technical support will result in day-for-day extensions of all project deadlines, and will not delay the payment of scheduled milestones.
Payment Terms and Protection
All payments must be processed securely via MicroFreelanceHub. The billing structure is milestone-gated to protect both parties and ensure project momentum:
- Initial Setup Deposit: A non-refundable deposit of fifty percent (50%) of the total project value is due immediately upon execution of this Agreement. Work will not commence until this payment has cleared.
- Mid-Project Milestone: A payment of thirty percent (30%) is due immediately upon the Client's digital approval of the CRO Audit and Testing Roadmap.
- Final Milestone: The remaining twenty percent (20%) is due upon completion of the test execution phase and delivery of the final analysis report.
If any invoice remains unpaid for more than five (5) business days past its due date, the Consultant reserves the right to immediately pause all active A/B tests, halt ongoing analysis, and suspend services without liability until the balance is paid in full.
Approval Milestones and Sign-Offs
To prevent delays and ensure alignment, the project will proceed through structured approval gates on MicroFreelanceHub. The Client must formally approve or request specific revisions to key deliverables (such as wireframe designs, test variants, or hypothesis roadmaps) within five (5) business days of receipt.
If no feedback or approval is submitted within this five-day window, the deliverable will be deemed automatically approved. An automatic approval authorizes the Consultant to progress to the next phase of work and triggers the associated milestone invoice where applicable.
Termination
Either party may terminate this Agreement at any time by providing ten (10) business days' written notice to the other party. Upon receipt of termination notice, the Consultant will immediately cease all active work and disable any running A/B tests to prevent site disruption.
In the event of termination, the Client shall pay the Consultant for all services rendered, hours worked, and milestones achieved up to the effective date of termination. Any upfront deposits or payments for milestones already completed are non-refundable.
Limitation of Liability
The Consultant utilizes professional expertise and standard statistical methodologies to design and execute CRO tests; however, because user behavior and external market conditions are unpredictable, the Consultant makes no guarantees regarding specific conversion rate increases, sales metrics, or revenue growth.
The Consultant's total liability for any claims, losses, damages, or expenses arising out of or related to this Agreement—whether in contract, tort, or otherwise—shall be strictly limited to the total amount of fees actually paid by the Client to the Consultant under this Agreement.
